NJ BILL NO. 2188

[New Jersey, NJ] — Sanipur is pleased to announce its support for New Jersey’s recently signed Bill No. 2188, which mandates comprehensive measures to prevent and control Legionnaires’ disease in public water systems and specific buildings. Signed into law by the Governor on September 12, 2024, this legislation underscores the importance of safeguarding public health through proactive water management strategies.

Bill No. 2188 specifically affects the owners and operators of public water systems with 100 or more service connections, as well as various facilities, including healthcare establishments, nursing homes, correctional facilities, and buildings with centralized hot water systems. Public water systems will now have to maintain minimum levels of disinfection in all areas of the distribution system at all times.

Key Provisions of Bill No. 2188:

  • Minimum Levels of Free Chlorine at 0.3 ppm and Minimum Levels of Monochloramine at 1.0 ppm throughout the municipal water distribution system
  • Water Management Plans: Facilities are now required to create water management plans that outline procedures for the control and monitoring of Legionella bacteria. These plans must be made available to relevant state agencies upon request.
  • Testing and Compliance: Regular testing for Legionella must be conducted by certified professionals, ensuring adherence to established safety standards.
  • Consequences for Noncompliance: The legislation imposes strict penalties for violations, including potential fines of up to $10,000 for building owners whose failures lead to serious injury or death, as well as investigations by the Department of Health following reported cases of Legionnaires’ disease.
